The Department leads the delivery of education and development services to children, young people and adults both directly through government schools and indirectly through the regulation and funding of early childhood services, non-government schools and training programs.

The Legal Division provides highly valued legal services across the Department's portfolios which include early childhood, schools, higher education, and training and skills.

About the role

An exceptional opportunity has arisen for an experienced lawyer to further progress your legal career by working in an outstanding legal team, in the Construction and Property Law Unit (CPLU) of the Commercial and Legislation (CAL) branch in the Legal Division of the Department of Education and Training. The role is full time, ongoing.

The CPLU sits within the CAL branch of the Legal Division. The CPLU provides property and construction legal services to the school network and DET corporate areas with a particular focus on the Victorian School Building Authority's (VSBA) School Building Program.

The successful candidate will be predominantly responsible for:

  • advising the Victorian School Building Authority of the Department (VSBA) in relation to facilitating land arrangements for the purposes of assembling sites for construction and third party use arrangements and upgrades, refurbishments and the construction of existing and new schools; and
  • advising the government school network in relation to capital works contracts, land issues and access licencing arrangements. 

The successful candidate will possess:

  • specialist construction legal expertise with the ability to provide high quality, solutions-focused, timely legal advice on property matters; 
  • strong construction drafting and interpretation skills with familiarity of AS2124 and AS4300;
  • construction dispute advice experience up to the point of litigation;
  • negotiation experience for government to government/NFP/community group partnering arrangements;
  • awareness of government protocols and processes - knowledge of legislative and policy frameworks in the education sector or of the WoVG construction procurement framework is highly valued;
  • property law expertise is highly valued; and
  • post qualified experience of 6 years or more.
